Terms of Supply
These are the Terms and Conditions of Quotation and Sale for all products and services supplied by G-TEC Electrical. Except as otherwise expressly agreed upon in writing between ADRIAANS, GLENN LEWIS trading as G-TEC Electrical and the Customer, the following Terms and Conditions shall apply notwithstanding any provisions to the contrary which may appear on any document or agreement between the Customer and G-TEC Electrical.
Acceptance of Terms: By placing an order, signing a quote, paying a deposit, continuing to provide instructions, or accepting our products or services, you are immediately bound by these Terms and Conditions.
1. Definitions
- Customer: The person or persons placing the order for Works and or products supplied by G-TEC Electrical to the Customer as specified in any invoice, document or order. The Customer warrants that they have the power to enter into this agreement and have obtained all necessary authorisations to allow them to do so.
- G-TEC Electrical: ADRIAANS, GLENN LEWIS trading as G-TEC Electrical (ABN: 98 257 478 351), the entity the Customer is contracting with whose business name and ABN appears on the quotation, invoice, receipt or other documentation provided to the Customer.
- Quote: Any document containing a price for Works, including but not limited to tax invoices, quotations generated by computer or tablet devices, or handwritten quotations.
- Works: Any electrical services rendered, products delivered, compliance certifications issued, or any future or completed work done by G-TEC Electrical, including all electrical installation, repair, testing, and certification work.
- Electrical Safety Certificate: Any certificate of compliance or electrical safety certificate issued pursuant to the Electrical Safety Act 2002 (Qld) and Electrical Safety Regulation 2013 (Qld).
2. Binding Nature and 3. Licensing
2.1 When Do These Terms Apply? All orders placed with G-TEC Electrical shall only be accepted subject to these Terms and Conditions. You are immediately bound by these terms if you place an order, sign any Quote, pay the deposit, continue to provide instructions, or accept the products or Works.
2.2 Can These Terms Change? G-TEC Electrical may, at any time, alter these Terms and Conditions and such altered Terms and Conditions shall apply after notification by G-TEC Electrical to the Customer.
3.1 Licensed Electrical Contractor G-TEC Electrical holds QLD Electrical License 91375 and ARC L153969. All electrical work is performed in accordance with the Electrical Safety Act 2002 (Qld), Electrical Safety Regulation 2013 (Qld), AS/NZS 3000 (Australian and New Zealand Wiring Rules), all relevant Australian Standards, and Queensland Building and Construction Commission requirements.
3.2 Compliance Certificates Where required by law, G-TEC Electrical will issue Electrical Safety Certificates upon completion of notifiable electrical work. These certificates remain the property of the Customer and copies are retained by G-TEC Electrical as required by Queensland electrical safety legislation.
3.3 Use of Subcontractors G-TEC Electrical may, at its discretion, engage verified and licensed subcontractors to assist with Works when project scope or timing demands it. All subcontractors engaged will hold appropriate Queensland electrical licences and insurance. Glenn from G-TEC Electrical maintains direct oversight and accountability for all Works regardless of whether subcontractors are engaged.
4. Pricing and 5. Payment Terms
4.1 Quote Accuracy If there is any error or omission in the Quote, G-TEC Electrical reserves the right to amend the contract sum. This clause applies even if the Quote has been accepted by the Customer. Prices quoted are subject to final costing assessment by G-TEC Electrical.
4.2 Deposits Upon acceptance of the Quote by the Customer, G-TEC Electrical may require a deposit to be paid prior to any Works being commenced. The requirement for and amount of the deposit is at the discretion of G-TEC Electrical and will be specified on the Quote.
4.3 Quote Validity The contract sum on the Quote will only be valid for 30 days from the date of the quotation. G-TEC Electrical reserves the right to make any changes to the Quote if the 30 days lapses.
4.4 Non-Refundable Deposits At G-TEC Electrical's sole discretion, once a Customer agrees to the Quote and pays the deposit, a portion or the full amount of the deposit may be non-refundable to cover costs and expenses incurred (for example, materials ordered, scheduling commitments, compliance certificate preparation). The non-refundable amount, if any, will be determined based on the circumstances and represents a genuine pre-estimate of costs incurred by G-TEC Electrical.
4.5 Variations G-TEC Electrical reserves the right to make any changes to the quotation including but not limited to the contract sum if either: (a) A variation is requested by the Customer, or (b) A Quote has not been fulfilled within 30 days of the date the Quote was produced. Any variation from the quotation, scheduled works or specifications will allow G-TEC Electrical the right to stop the progress of any works until G-TEC Electrical and the Customer agree to changes. Payment for all variations will be added to the final invoice, unless otherwise agreed in writing.
4.6 Order Cancellation After G-TEC Electrical accepts your order you may not cancel the order unless G-TEC Electrical agrees in writing. G-TEC Electrical reserves the right to supply an order in full or only in part.
5.1 When Is Payment Due? The Customer shall make payment according to the Quote. Unless otherwise agreed in writing, payment in full is due upon completion of the Works.
5.2 Accepted Payment Methods Accepted payment methods include Bank Transfer (EFT), Cash, and Credit Card. Payment details will be provided on the invoice.
5.3 Late Payment If the Customer fails to make payment, G-TEC Electrical shall be entitled to: (a) Require cash payment for future Works; (b) Charge default interest at 9% per annum on overdue amounts; (c) Claim all costs relating to debt recovery including legal costs; (d) Cease further Works and terminate the agreement.
5.4 No Set-Off The Customer shall not be entitled to set off against, or deduct from the contract sum, any sums owed or claimed to be owed to the Customer by G-TEC Electrical nor to withhold payment of any invoice because part of that invoice is in dispute.
6. Completion Time and 7. Inspection
6.1 Completion Time Estimates Any date or time quoted for delivery and completion of the Works is an estimate only. G-TEC Electrical shall endeavour to complete the Works at a time or times required by the Customer, but failure to do so shall not confer any right of cancellation, termination or refusal of delivery on the Customer's part or render G-TEC Electrical liable for any loss or damages directly or indirectly sustained by the Customer as a result thereof.
6.2 Delays Beyond Our Control The Customer will not be relieved of any obligation to accept or pay for products by reason of any delay in delivery or any strike, lockout, unavailability of raw materials, accidents to machinery, differences with workmen, breakdowns, shortages of supplies or labour, fires, floods, storm or tempest, transport delays, acts of God, restrictions or intervention imposed by any laws, regulations, governments or agencies thereof, and any other cause beyond the control of G-TEC Electrical.
7.1 Customer Inspection The Customer shall examine the products immediately after delivery and G-TEC Electrical shall not be liable for any misdelivery, shortage, defect or damage unless G-TEC Electrical receives details in writing within 14 days of the date of delivery of the products.
7.2 Installed Products If G-TEC Electrical is employed to install said product or products, the Customer shall not open, dismantle or otherwise handle the product or products prior to or during installation.
8. Property and Risk
8.1 Retention of Title Notwithstanding delivery of the product or products or their installation, property in any given products shall remain with G-TEC Electrical until the Customer has paid and discharged any and all other indebtedness to G-TEC Electrical on any account whatsoever including all applicable sales taxes and any other taxes, levies and duties. Any payment made by or on behalf of a Customer which is later voided by the application of any statutory provision shall be deemed not to discharge the Customer's indebtedness.
8.2 Bailee Responsibility The Customer acknowledges that they are in possession of the products solely as a bailee for G-TEC Electrical until payment has been made in full to G-TEC Electrical and until such payment, the Customer shall be fully responsible for any loss or damage to the goods whatsoever and howsoever caused following delivery.
9. Force Majeure
G-TEC Electrical shall not be liable for any failure or delay in supply or delivery of the products or Works where such failure or delay is wholly or partly due to any cause or circumstances whatsoever outside the reasonable control of G-TEC Electrical including, but not limited to war, strikes, lockouts, industrial disputes or unrest, government restrictions or intervention, transport delays, fire, act of God, breakdown of plant, shortage of supplies or labour, storm or tempest, theft, vandalism, riots, civil commotions, pandemics, or accidents of any kind.
10. Product Substitution
If any products and Works specified within the quotation are unavailable at the time of the Works being carried out, G-TEC Electrical in its absolute discretion may substitute a reasonable alternative of equivalent quality and functionality. Where practical, the Customer will be notified of any material substitutions.
11. Warranties
**11.1 Workmanship Warranty To the extent required by statute, subject to the conditions of warranty as may be set out in the Australian Consumer Law located in Schedule 2 of the Competition and Consumer Act 2010 (Cth), G-TEC Electrical provides a lifetime workmanship warranty on all Works. If a defect attributable to workmanship in any of the Works carried out by G-TEC Electrical is reported to G-TEC Electrical, G-TEC Electrical will either replace or remedy the Works subject to these Terms and Conditions.
11.2 Warranty Exclusions This warranty will not be applicable in any of the following circumstances: (a) Defect or damage caused by failure to properly maintain any Works, follow instructions, or by the Customer's negligence; (b) The Customer continues to use any of the Works after any defect becomes apparent; (c) The Customer allows someone other than a licensed electrical professional to modify, repair, or interfere with the Works; (d) If the Works fail due to fair wear and tear, any accident or act of God; (e) Damage caused by electrical surges, lightning strikes, or power supply issues beyond G-TEC Electrical's control.
11.3 No Unauthorised Repairs The warranty shall cease and G-TEC Electrical shall thereafter in no circumstances be liable under the terms of the warranty if the Works are repaired, altered or overhauled without G-TEC Electrical's express written consent.
11.4 No Compensation for Delays In respect of all claims, G-TEC Electrical shall not be liable to compensate the Customer for any delay in either replacing or remedying the workmanship or in properly assessing the Customer's claim.
11.5 Site Inspection Charges If G-TEC Electrical must make a site inspection, G-TEC Electrical may charge the Customer for all reasonable costs incurred including labour, travelling and other out-of-pocket expenses if the fault or defect is deemed to be outside this warranty.
11.6 Third-Party Components Components and parts from third-party suppliers are subject to the same warranty (if any) as is extended to G-TEC Electrical by the supplier. Manufacturer warranties for products such as switchboards, smoke alarms, circuit breakers, and other electrical components remain with the original manufacturer.
12. Customer Acknowledgements
12.1 Order Verification It is the sole responsibility of the Customer to check and confirm the order with G-TEC Electrical prior to signing the Quote. G-TEC Electrical will not be held liable for incorrect orders.
12.2 Site Access and Preparation The Customer is responsible for: (a) Ensuring that the Works can be completed without interruption, in a continuous work flow and on the mutually agreed date; (b) Ensuring that G-TEC Electrical has clear and free access to the work site at all times; (c) Ensuring that plumbing, electrical installations and any other installations not specified within the quotation do not impede the work area; (d) Providing any necessary foundations, structural support, or site preparation; (e) Ensuring compliance with any body corporate, strata, or building management requirements; (f) Obtaining any necessary approvals or permits not included in the scope of electrical work. G-TEC Electrical reserves the right to charge the Customer any extra costs incurred by virtue of site issues including but not limited to additional return-to-site charges and travel costs.
12.3 Site Conditions and Safety G-TEC Electrical shall take all due and reasonable care when delivering and installing the product or products. However, G-TEC Electrical shall not be liable for: (a) Pre-existing damage to the site; (b) Damage to concealed services not identified prior to commencement; (c) Issues arising from inadequate site preparation; (d) Asbestos or hazardous materials discovered during Works (work will cease immediately and Customer will be notified); (e) Discovery of non-compliant pre-existing electrical work requiring rectification.
12.4 Custom Requirements The Customer accepts all liability for, and indemnifies G-TEC Electrical against, any custom orders or additional requests that are outside the usual scope of works, including but not limited to anything that is labelled as a client or customer requirement. The usual scope of works, and what is outside same, is determined solely by G-TEC Electrical.
12.5 Aesthetic Considerations G-TEC Electrical accepts no liability for the visual presentation or noise levels of installed products beyond ensuring they comply with manufacturer specifications and Australian Standards.
13. Limitation of Liability
13.1 Australian Consumer Law Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy conferred on the Customer by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted or modified by agreement.
13.2 Liability Limitation Subject to clause 13.1, and to the maximum extent permitted by law: (a) G-TEC Electrical's liability for breach of any non-excludable consumer guarantee is limited, at G-TEC Electrical's option, to: replacement, repair, payment of the cost of replacement or repair (for goods); or re-supply or payment of the cost of re-supply (for services). (b) G-TEC Electrical shall not be liable for any indirect, consequential, special or exemplary loss or damage (including loss of profit, loss of business, loss of data) suffered by the Customer. (c) G-TEC Electrical's total liability arising out of or in connection with the Works shall not exceed the total amount paid by the Customer for the specific Works giving rise to the liability.
14. Insurance
G-TEC Electrical maintains appropriate public liability insurance and professional indemnity insurance as required for electrical contractors in Queensland. Evidence of insurance can be provided upon reasonable request.
15. Termination
If the Customer fails to comply with any of these Terms and Conditions or being a natural person commits any act of bankruptcy or being a corporation passes a resolution for winding up or liquidation (other than for the purposes of reorganisation or reconstruction), G-TEC Electrical may: (a) Suspend any further deliveries; (b) Immediately recover possession of any products not paid for; (c) Terminate the agreement; (d) Claim all amounts due and owing. If a Customer cancels or alters any order, G-TEC Electrical reserves the right to charge the cost of any product or materials already acquired together with cost of labour and tooling expended to the date of such cancellation.
17. Privacy
G-TEC Electrical collects personal information such as Customer name, address, email, phone number, and details relating to the electrical services requested or provided. This information is held securely for purposes including providing quotes, delivering services, invoicing, maintaining job records (including compliance certificates), and managing warranties. Information may be held for a period necessary to meet legal and operational requirements (typically 7 years for financial and electrical safety compliance records as required under Queensland legislation). 18. General Provisions
These Terms and Conditions are governed by and construed in accordance with the laws of Queensland, Australia. G-TEC Electrical may assign all or any part of its rights and obligations without the Customer's consent. The Customer may not assign their rights without G-TEC Electrical's prior written consent. These Terms and Conditions, together with any Quote accepted by the Customer, constitute the entire agreement between the parties and supersede all prior agreements, understandings, and representations.
19. Emergency Electrical Services
G-TEC Electrical offers emergency electrical services for urgent safety issues outside normal business hours. Emergency callout rates apply and will be communicated to the Customer before attendance where practical. Emergency work is limited to making the electrical system safe and restoring essential services. Full repairs or installations may require a separate quote and scheduled attendance during normal business hours.
